These Terms and Conditions govern the use of our website, booking of events, and rental of our venue facilities at Blue K Homestead Company LLC d.b.a. Rotherwood Events (3565 Paris Rd, Winchester, KY 40391). By browsing our site, inquiring about bookings, or entering into a rental agreement, you agree to these terms. These are a summary; the full, binding terms are in the signed Rental Agreement provided upon booking.
General Provisions
Blue K Homestead Company LLC d.b.a. Rotherwood Events (referred to as "we," "us," or "the Venue") owns and operates the facilities. Bookings are for private events such as weddings, gatherings, or agritourism activities on our working farm property.
You (the "Client" or "Host(s)") must be at least 18 years old to book. Use of the Venue is at your own risk. As a working farm, inherent risks exist (e.g., uneven terrain, animals, wildlife smells/sounds, weather). We provide ADA accommodations like level parking and ramps where possible.
Booking and Payment Terms
- Bookings are confirmed upon a signed Rental Agreement and non-refundable reservation fee (typically 1/3 of total).
- Remaining payments: Second 1/3 due 6 months prior; final balance plus security deposit due 30 days prior.
- We accept cash or checks (payable to Blue K Homestead). Late payments incur $75 fees; non-payment may cancel without refund.
- Rental fees cover specified hours (including setup/teardown), staff, tables/chairs, kitchen use, grounds/photography access, and basic assistance (not coordination). Extras (e.g., scissor lift for decorations: $25/hour up to 2 hours) billed separately.
- Final guest count due 30 days prior; exceeding may incur fees or limit accommodations.
Cancellation and Refund Policy
- Reservation fee is non-refundable. Cancellations >90 days prior may refund partial payments (minus fee); within 90 days, non-refundable.
- Late payments or missing insurance cancel without refund.
Venue Use and Rules
- Rental periods include setup/teardown; overtime: $75/15 minutes or $225/hour (pre-approved). Events end by 11:30 PM (music by 11:30 PM Fridays/Saturdays, earlier midweek); all off-site by midnight.
- Maximum guests: 216 indoors (barn fire code); exceeding terminates event.
- Prohibited: Smoking/vaping indoors (designated outdoor area only), open flames/fireworks, drugs, excessive noise, unauthorized alterations, leaning on railings, climbing trees/structures, entering animal areas, or items like glitter/confetti/adhesives (full list in Rental Agreement).
- Alcohol: Licensed bartenders only (1 per 100 guests); no self-service; stops 1 hour before end. Violations forfeit deposit and may end event.
- Children under 16 must be supervised; no wandering near animals/equipment/water. Fees for unsupervised incidents.
- Pets prohibited (biosecurity risks); exceptions require approval/vaccination/proof.
- House/Bridal Suite: Limited access (e.g., 1 hour post-ceremony); no more than 20 people; doors must close gently.
- Weather: No refunds for inclement weather; tents/heaters allowed with approval.
Vendors and Insurance
- We do have an open vendors policy but they must be approved vendor by the venue owners; vendors not from our list require 30-day submission with COI/licenses—RE approves/denies.
- Vendors must comply with rules; no alcohol consumption. Host(s) responsible for sharing Terms & Conditions and any violations/damages.
- Insurance: $1M liability policy required (naming us additional insured); covers all days (including rehearsals). Third-party vendors need own COI. Failure cancels without refund.
Cleanup and Damage Responsibility
- Leave Venue "as is" (normal wear excepted). Remove all items/trash by end; excessive cleanup: $75+ fees.
- Damages (e.g., to grounds, animals, structures) deducted from security deposit (returned within 30 days if clear, with itemized notice). Host(s) liable for excess via insurance.
- Check-in inspection required; report issues immediately.
Liability Waiver and Assumption of Risk
As an agritourism venue on a working farm, inherent risks exist (e.g., terrain, animals, weather, smells/sounds). By booking/attending, you and your guests assume these risks and release us from liability for injuries/losses/damages (except gross negligence).
We recommend event liability insurance naming us as additional insured. Photos/videos may be used for promotion; opt out via contact.
Indemnification
You agree to indemnify and hold us harmless from claims arising from your event, including guest/vendor actions, even if concurrent with our negligence (except sole negligence).
Force Majeure
We are not liable for failures due to uncontrollable events (e.g., weather, epidemics, power outages). We may refund (minus reservation fee) or credit at our discretion.
Intellectual Property and Photography
All content on our website/promotions is our property. Unauthorized use prohibited.
Governing Law and Dispute Resolution
Governed by Kentucky law. Disputes: Negotiate in good faith (30 days), then mediate in Clark County before litigation there. No jury trial.
Changes to Terms
We may update; continued use accepts. Amendments require written agreement.
